Super Fun Days Out – Terms and Conditions
BOOKING PROCESS
Bookings can be made by filling in our booking form accessible via any of the products on our site.
Once you have booked a product(s) and we have confirmed with the providing company the availability of the day you have chosen we will send you a confirmation in the form a paypal invoice. You must pay this within 48 hours if you wish your booking to be secured. Any delay in your reply after this period could result in you losing your preferred date and time, which we cannot be held responsible. When you book online, you provide all the details of the product you require and are requested to acknowledge that you have read and understood the terms and conditions as detailed. Please read the terms of your booking carefully.
Your payment prevents others from booking activity on a specific time on a specific date and is therefore subject to our cancellation policy (see below). This is in line with Regulation 6 within the Distance Selling Regulations issued by the Office of Fair Trading. In relation to accommodation or other supplies your payment holds these supplies for you and prevents other prospective customers from booking them and therefore are also subject to the cancellation conditions as described.
On receipt of the required payment, you will receive confirmation of your booking and a receipt for your payment, which will have the address and phone number of the venue and any other relevant information. We suggest that the postcode given is used to generate a map online using Google Maps or that you use our site to confirm the exact location before undertaking your activity. If you do not receive a full address for the venue on your receipt it is your responsibility to contact us immediately and request these details. If you fail to do this and cannot find the venue you accept full responsibility. We can be contacted by phone or by email during a normal working week. Please give full details of your booked event.
When purchasing a package from us, if an online booking is placed within 31 days of the requested booking date, full payment is required if we can place your requested package or the most suitable package for your group size, type and age, in the time period you have specified. If the package booked is more than a month from booking date, we require a 25% deposit of the full amount, with the further 75% due 31 days prior to the date of the experience(s). However, we will ask for no payment until we have booked your package with the providing companies.
CANCELLATION CHARGES
Once your booking is confirmed with the venue your right to cancel without penalty ends: The terms of cancellation are as follows:
- Once a deposit is taken and your booking is confirmed with the venue(s): Loss of deposit
- 31 days or more prior to the event: Full refund of monies paid less deposit
- 31 days or less prior to the event: No refund
Our accepted date of cancellation is the date that your written cancellation is acknowledged in writing by us. If you have not received an acknowledgement in writing, we have not received your cancellation and your booking remains in place.
Any reduction in numbers must also be confirmed in writing and acknowledged in writing by us to be considered valid.
Any changes in participant numbers are subject to the same cancellation charges as stated above. Please note that in addition, changes in numbers could affect the per person cost of your activities, as it could reduce any group discount offered by the individual providers.
BAD WEATHER / OTHER UNAVOIDABLE CIRCUMSTANCES
If a venue cancels due to bad weather or any other unavoidable circumstances, your booking will be rescheduled to a mutually convenient date for yourself and the venue in question. You can chose a date up to three months after the original booked date. This is arranged between the venue and you. We will not get involved. If a cancellation is due to a venue closing or becoming unsuitably qualified to remain in our directory, we will offer you a similar venue nearby as an alternative. Should you decide this is not satisfactory for your requirements, in this case a full refund will be provided. Bookings at all-weather venues will not be eligible for a refund if the venue is prepared to run the session. A customer decision not to take part in these circumstances will result in it being deemed that they have cancelled their booking and such action will be treated as a normal cancellation and charges as stated will apply.
ARRIVING LATE
All our venues require participants to be ready to take part in the activity 15 to 30 minutes prior to a designated “start-time” to enable a full safety briefing to take place. The time you receive on your confirmation is your “start time” with a recommendation to arrive at least 30 minutes prior to the activity beginning, please also be aware that some companies require an even earlier arrival, though this was specified. It is important to ensure that you follow these guidelines of arrival times. All our venues will do their best to accommodate late arrivals but this cannot be guaranteed, especially during busy periods. Many venues will refuse to allow participation if a customer has missed the safety briefing. Some of our venues and activities will make an exception to this and provide individual safety briefings, but this in entirely at the individual venue’s discretion and cannot be guaranteed The booking will normally be treated as a cancellation in the event of late arrival with the loss of all monies and the venue can turn you away, particularly if they have a busy schedule to meet. This is their right to do so. Please also take into consideration travel times and possible delays and do your best to arrive on time at the venue.
EXCLUSION FROM VENUE
The venue has the right, at all times, to refuse participants access to the booked activity at any stage of the booking and remove them from their venue if in their opinion the participants are unsuitable for participation. This could be for any of the number of reasons listed below or at the venues own discretion:
- under the permitted age
- are the incorrect height or weight
- are unfit to take part in the activity because of physical or mental impairment
- be under the influence of alcohol or drugs
- or are displaying aggressive and abusive behaviour (verbal or physical)
- have arrived too late to take part in the pre-activity briefing
- consider them to be a danger to themselves, other participants or members of staff
If any of these occurrences apply, the booking will have been deemed to have been cancelled and cancellation charges will apply. There are no exceptions.
In the event of any participant damaging the property of the venue or verbally or physically injuring a member of the staff or other participants, they will be dealt with by the venue management accordingly and may face prosecution by the venue. We will not become involved in such matters other than to supply the venue and authorities with contact details of the offending party / parties. Any communications relating to such matters should be conducted between the venue, the offending party / parties and the authorities.
ACTIVITY DESCRIPTIONS / RESTRICTIONS
All the activities featured on our websites are described in as much detail as possible and are correct at the time each booking is made. All prices are per person unless specifically stated otherwise in your activation email. From time to time activities do change both in price, type and duration. When we receive notification of any changes we amend our websites accordingly as soon as possible. If a change to an activity is made on the date of delivery and you are not happy with the change you must take this up with the venue. Before undertaking activities, customers are deemed to have thoroughly familiarised themselves with the all restrictions, including height, weight and age restriction as detailed on our websites before booking the activity. No responsibility can be accepted by us if you choose not to familiarise yourself with all aspects of the activity in question at the venue chosen.
PERSONAL SAFETY / HEALTH REQUIREMENTS
Whilst all the activities featured on our websites are as safe as they can be given their inherent physical dangers, you must take all safety instructions and guidance provided at the site very seriously. You must ensure that before taking part, that you and the other members of your groups have listened and understood all safety instructions and are wearing any safety equipment or clothing properly. If in any doubt you must seek further guidance and help from the venue immediately. We must also advise you not to attempt to go beyond your capabilities or engage in risky or daring behaviour. We also suggest that ensure that any personal insurance is up to date and accounts for any health risk relating to the activity you are undertaking. Before taking part in any of our activities you must be physically and mentally fit and be capable of taking instructions.
DRIVING LICENCE
For karting and quad biking no driving licence is required. Our off-roading and other driving experiences do require a full UK driving licence that you have held for at least one year. (Some activities will require longer, but this will be specified in restrictions) You must also take your licence for inspection on the day. Failure to produce a licence for this type of activity will result in you not taking part in the activity and this will be deemed as a cancellation.
COMPLAINTS
When arriving at the designated venue, if you are dissatisfied with your booked activity in any respect, then you must speak to the activity provider on the day and reach an agreement about how you the situation can be resolved. We do not believe it to be reasonable if you have not brought your complaint to the attention of the activity provider at the time of dissatisfaction and then choose to complain later. If you take part in an activity, either the booked activity or a replacement offered by the venue on the day it is deemed that you are satisfied with the activity and further complaints will not be considered. We represent a network of activity providers but do not deliver the activities personally. Please make a note of the contact name and all details at the venue. Photos should also be taken as proof of your complaint. Should you have a genuine complaint against our handling of the booking process, please email customer.services@superfundaysout.com. Once we receive your complaint we will investigate your claim and discuss the matter with the relevant parties. When we have gathered all the necessary information, we will get back to you.
REFUNDS
Should you be deemed eligible for a refund then this will be for the agreed amount with the absolute maximum amount being the monies you have paid to us and will not extend to consequential loss or claimed inconvenience or stress howsoever caused. No exceptions are made in this regard. If you have taken part in any activity during the booked event in question, regardless of the circumstances or conditions under which you took part, then this will negate any applicable refund.
OFFICE OF FAIR TRADING & TRADING STANDARDS
Super Fun Days Out Limited complies with regulations and guidelines as laid down by the Office of Fair Trading and Trading Standards for the service we offer. We welcome any inspection of our processes in this regard.
DATA PROTECTION
Super Fun Days Out Limited complies with the principles of the Data Protection Act 1998.
TERMS AND CONDITIONS OF SUPPLIERS
Many of the companies and services which make up your booking are provided by independent suppliers. Please be aware that these suppliers provide services subject to their own terms and conditions. Some of these terms and conditions may limit or exclude the supplier’s liability to you. Copies of the relevant parts of these terms and conditions are available on request from the supplier concerned.
OUR TERMS
All bookings will be subject to these same terms and conditions without exception. All customers will have deemed to have made themselves aware of these Terms & Conditions and will have accepted them in their entirety and without exception as part of their booking with us.
All of the separate clauses of these Terms and Conditions stand-alone, thus if any clauses are found to be invalid, it does not affect the validity of any other clauses.
These terms and conditions are subject to English Law.
